1. Confirmation of the Agreement

In order to be a member of ECCTUR.COM, you should fill in our registration form and you should accept and undertake that you will follow the terms of the user agreement.

Therefore, if you select ''I agree to the terms of use of the website.'', you agree to the terms written below.

The user is deemed to have committed to comply with the agreement of ECCTUR.COM from the moment he/she has completed and approved the registration form or received any service or made a reservation using this system.

2. Description of Services

ECCTUR.COM provides members that confirmed the agreement a chance to make hotel room reservations online.

3. ECCTUR.COM Membership System

• The member of ECCTUR.COM will have a ''user name'' and a ''password'' that he/she determines himself/herself.
• The ''user name'' is specific to a member and the same ''user name'' is not given to two different members.
• The ''password'' is only known by the user. The user can change the password at any time. The choice and protection of the password is entirely the responsibility of the user. ECCTUR.COM is not responsible by any means for any problems that may arise from using the password.
• COM can inform the users about the promotions they can benefit from by e-mail. ECCTUR.COM does not share the user information with third-party companies by any means - the phone number and e-mail address can be shared with the accommodation facility in relation to the faster and more accurate delivery of the booking request. But it does not send emails on behalf of third-party companies.
• In order for the user to be able to connect to the services that require ECCTUR.COM membership, he/she must enter his/her username and password. This process is defined as ''log in'' to ECCTUR.COM.

4. The Liabilities of Member

When benefitting the services of the ECCTUR.COM website, the member accepts and undertakes that,

• the information contained in the registration form is correct and when this information is necessary, he/she is responsible for any trouble and damages that may arise from incorrect or incomplete information (including forgetting the password), his/her membership may be terminated in these cases,
• the copyrights of services and software provided by ECCTUR.COM belongs to ECCTUR.COM and he/she will not copy and distribute this software by any means,
• the responsibility of the personal thoughts, opinions, statements that he/she puts forward when using the services and software of ECCTUR.COM, and files he/she added to the ECCTUR.COM environment, requests he/she sent and personal information belongs to himself/herself and that ECCTUR.COM cannot be held responsible in any way for these files,
• the pictures or information that belongs to persons above the age of 18 may appear in the services provided by ECCTUR.COM and ECCTUR.COM cannot be held responsible for these,
• COM will be responsible for any information, messages and files that will be lost, missing, or transmitted to the wrong address during the use of the website,
• he/she will not access the services provided by ECCTUR.COM outside of the form determined by ECCTUR.COM and in an unauthorized manner, and he/she will not modify the software in any way, will not use the ones that are obvious to have been changed, and pay all material and moral damages that ECCTUR.COM may suffer if he/she does not comply with these terms,
• COM cannot be held responsible for the unauthorized reading of member data and for damage caused by this,
• he/she will not send messages that are threatening, unethical, racist, against the Laws of the Republic of Turkey or International Treaty,
• the correspondences, titles, or nicknames that will be added to the environment will be consonant with general rules of good manners and to the rules of law,
• he/she will not harass or threaten other users,
• he/she will not act in a way that will affect the other users' use of the site,
• he/she will not share, print, or distribute any material or information that stains and violates the names of persons or institutions, or is immoral, indecent, or illegal, and that he/she will not interfere in the surveys in the website from inside or outside,
• he/she will not advertise anything, will not sell or offer to sell any goods or services, will not participate in surveys, contests, or chain letter activities about the site,
• he/she will not send information or programs that will damage the information or software in the computers of other users,
• any registration or all materials obtained using the ECCTUR.COM services are within the consent of the user, he/she is fully responsible for any failures, loss of information and other losses that these may cause on the user's computer, he/she will not claim compensation from ECCTUR.COM for damages that he/she may suffer due to the use of the service,
• he/she will not use the services of ECCTUR.COM with commercial or advertisement purposes positively or negatively without the permission of ECCTUR.COM,
• COM can monitor the system at any time or constantly,
• in case he/she acts against the terms, ECCTUR.COM has the right to make the necessary interference, to remove the member from the system and terminate his/her membership,
• COM can use its system for commercial purposes,
• he/she will not post information that is prohibited by law and will not distribute the mails such as chain mails, software viruses (etc.) that is not authorized to be sent,
• he/she will not save or misuse the personal information that belongs to others,
• he/she will be held responsible for all kinds of transactions that will be made using his/her username,
• the customer must pay the accommodation fee reported to him/her during or before the booking process under the conditions announced by the accommodation facility in which he/she has personally booked, that otherwise the room may not be delivered to them,
• if the customer wishes to cancel his/her reservation that's made from ECCTUR.COM, he/she will act in accordance with the cancellation conditions announced on the site by the accommodation facility he/she has personally booked, the accommodation facility may request and collect all or part of the booking price from the customer by not accepting cancellation notices made outside of the cancellation conditions,
• if the reservation that's made by the member will be used by another person, this person will have to sign a document that he/she can present to the person who delivered the room to him/her on behalf of the Virtual Center "as to he/she knows the person who made the reservation on behalf of him/her", the reserved room may not be allowed to be used by him/her if the document is not signed and therefore, apart from the booking is considered be off, all or part of the booking price may be requested and collected from the member that made the reservation due to con-compliance with the cancellation conditions.

5. Authorizations Granted to ECCTUR.COM by Users

• COM may temporarily suspend or entirely stop the operation of the system at any time.
• COM assumes no liability to its members or third parties for the temporary or complete suspension of the system.
• The user name and password will be provided to the member by ECCTUR.COM and will be effective after completing the application areas. ECCTUR.COM can prevent the customers that's completed the forms or the customers that's connecting while already having a password to have new passwords or using their passwords indefinitely if deemed suitable.
• COM undertakes that the reservation will be transmitted to the accommodation facility in a timely, safe and error-free manner. However, it does not undertake that the use of the reservation that's made and/or the results obtained are accurate and reliable, and that the quality of the room and service will meet expectations.
• COM has the authority to back up or delete some or all of the files, messages, information that the members will have while benefitting the services in the periods that will be deemed suitable. ECCTUR.COM cannot be held responsible for the backup and delete processes.
• All the information, documents, software, design, graphics, etc. bought from outside and/or produced by ECCTUR.COM are copyrighted.
• COM's sales are limited by its current presence and number of uses in the premises of its own companies.ECCTUR.COM may not receive a reservation request for rooms that are not available in the relevant accommodation facilities. The display of the accommodation facilities and rooms on the website does not mean these rooms are in stock or open to sale and reservation by ECCTUR.COM. At the same time, that does not undertake that these hotel rooms can be booked definitely.
• COM has the right to publish and/or carry and publish creations such as information, documents, software, designs, graphics, etc. that the members produced and uploaded to the system willingly (e.g. a message, poem, news, survey, file added to clipboard) on the website or in another address deemed appropriate by ECCTUR.COM. It is possible that this published information will be copied and/or published by other users. In these cases, the user will not request any kind of royalty, compensation, etc. from ECCTUR.COM.
• The changes in the prices of the accommodation facilities, room properties, conditions of sale, cancellation and reservation or general characteristics of the facilities offered for sale in ECCTUR.COM are at the initiative of the accommodation facilities exclusively. Accommodation facility enterprises that have virtual rooms on the ECCTUR.COM website are responsible for the up-to-dateness, modification, and accuracy of this information. If an error occurs in prices and the information described above, ECCTUR.COM may undertake the service to correct or compensate for this error or may completely cancel the customer's reservation.
• COM may transfer the member to other websites. In this case, the member accepts that ECCTUR.COM is not responsible for the content of the sites to which he/she will be transferred.
• COM may modify the application of this Agreement or modify or add new substances in order to comply with the technical requirements and legislation that may arise in the future.
• COM's services, which do not require membership, can be converted into membership-requiring situations over time. ECCTUR.COM may open additional services, modify some or all of its services, or convert them into paid services.

6. Personal and Non-Commercial Use Restriction:

Retail customers accept that all purchases made are for personal use and that the purchases are not for resale purposes. Corporate customers can use the website for commercial purposes as well as they can use it for the employees in their corporation. For those who use it for commercial purposes, if there is no contract between the parties separately and in writing, no commission is paid for the sales made by these businesses. Companies that will sell for commercial purposes are required to have a Travel Agency Business Certificate. No commission is paid for the reservations that corporate companies does for their own personnel if there is no separate contract.

Those who make reservations from accommodation facilities by using the ECCTUR.COM website will not be charged a fee for using the site or for any other reason.

7. Price, Payment, Invoice, Commission and Taxation:

Transactions arising from all legal changes that may take place outside the scope of this Agreement shall be excluded from the responsibility of ECCTUR.COM company and are exactly reflected in the Agreement.

Since payment for the reservation is made directly to the hotel, there is no commercial exchange between the website user customer and the ECCTUR.COM.

The customer makes the payment to the accommodation facility that he/she has booked, and requests and receives the invoice to be issued in his/her name directly from the accommodation facility.

8. Use of The Room That's Booked

If the customer does not respond to the reservation made by using the ECCTUR.COM system, the cancellation conditions announced by the accommodation facility at the time of booking are applied to the customer. As part of this situation, the customer must accept and fulfill the legal debts and obligations to both ECCTUR.COM and the accommodation facility.

9. Cancellation of Booking

Cancellation conditions may differ for each company that takes part in the website of ECCTUR.COM. For this reason, cancellation conditions that are announced by the accommodation facility during reservation are read and accepted by the user customer.

In addition to this; refund or cessation of the payment of credit card may be made directly to the customer by accommodation facilities if the following conditions exist. However, it is valid for some reservations paid by online credit card and is limited to the following conditions. In such cases, ECCTUR.COM will share the direct contact information of the parties to the parties on demand.

• If the booking request did not reach the accommodation facility, if it's clearly notified by the accommodation facility that the reservation request cannot be accepted, if the hotel or the room's state is not available, if the customer duly canceled the reservation without penalty and the cancellation process is confirmed by accommodation facility;
• Notification by the accommodation facility that the reservation has become partially or completely impossible,
• In case of cancellation due to failure to deliver booking information to accommodation facility;
• In cases of cancellations made due to dissatisfaction with the service and quality of the booked accommodation facility, or made before entering the facility due to its incompatibility with the promotional information of the facility and are accepted by the facility,

In cases of cancellation of reservations paid by Online credit card and payment means other than this; refunds are made by the accommodation facilities that ECCTUR.COM comprise. ECCTUR.COM is not a party in disputes that may arise between the accommodation facilities and the customer regarding the terms of the refund. ECCTUR.COM provides registration and information about reservations made from the system to the relevant persons upon request. ECCTUR.COM cannot be held responsible for deletion from the system or back up of this information.

10. Property of Being Conclusive Evidence and Validity of ECCTUR.COM Records

The member accepts, declares and undertakes that in the disputes that may arise from this agreement, ECCTUR.COM's book entries, microfilm, microfiche and computer records shall constitute valid, binding, definitive and exclusive evidence within the context of article 287 of Code of Civil Procedure, this article qualifies as an evidence agreement, he/she renounces in advance from his/her right of objection and right to tender an oath regarding that stated records of ECCTUR.COM is held duly.

11. Applicable Provisions

In disputes related to this agreement, the provisions in this contract will be applied first, and in the cases where there are no provisions, the current Turkish Legislation (Turkish Law of Obligations, Turkish Commercial Code, Code of Civil Procedure, Consumer Protection Law and other related laws) will apply.

12. Authorized Courts, Enforcement Offices and Validity

For resolving any disputes that may arise from the application of this agreement, Istanbul Çağlayan Courts and Enforcement Offices shall be authorized. After the user has completed the registration form, read and accepted the terms of use of the system while registering on the website, this Agreement enters into force between the parties without any period of time when he/she gets a service or makes a reservation by using the system.
